The Gauhati High Court (HC) restrained BCCI from 'taking a final decision' on IPL tender

The Gauhati High Court (HC) today restrained the Board of Control for Cricket in India (BCCI) from “taking a final decision” on the tender floated on October 14 for selection of new teams for 2013 IPL tourney.

A single judge of the high court, B D Agarwal also sought a response of the Centre, BCCI and the Assam Cricket Association on a PIL filed by Ghisa Lal Agarwal, editor of a vernacular daily challenging non-inclusion of any team from Guwahati in the 12 teams short-listed for participating in the bids.

However, the court said BCCI may go ahead with the process for selection of teams which would be subject to it final orders.

The petitioner had submitted that Guwahati, despite being the gateway of north eastern states with better infrastructure and facilities, has not been included in the auction process for IPL teams.

It was submitted that exclusion of Guwahati from the new teams is an act of discrimination by BCCI which is recognised by the government of India as it is undertaking public duties and functions in the matter of cricket game.

The court, after holding that there was a prima facie case for entertaining the PIL, issued notices to the respondents for their replies by November 11.

Addressing a press conference here today, Agarwal said BCCI had invited tenders for new teams from cities like Ahmedabad, Cuttack, Dharamsala, Indore, Hyderabad, Kanpur, Kochi, Nagpur, Noida, Rajkot, Ranchi and Vizag ignoring Guwahati and other north-eastern cities. Agarwal claimed that being the premier city of the entire north-eastern region and host of several One-Day International matches, Guwahati should have been considered as an IPL venue and a team from this city should be included in the IPL from 2013.

In support of his PIL he said, “If Guwahti is included as an IPL venue new players will emerge from this region and cricket infrastructure will get a boost.

But when asked whether he consulted the ACA before filing the PIL, Agarwal said “This is their first step and they will consult the matter with ACA soon. On the other hand, ACA is the authority to which BCCI will allot IPL matches. At present, ACA or the State does not have the necessary infrastructure where IPL matches could be staged.

When contacted, ACA secretary Bikash Baruah said as the subject is sub-judice there is no point discussing the matter with Agarwal and his organisation. Baruah said at present, ACA does have a proper stadium with all the facilities to hold an IPL match and when the Barsapara Stadium is completed they will definitely urge BCCI to allot IPL matches here.
